. Agreement to Terms
Welcome to CALIFORNIA YOUTH & ARTS (“CY&A,” “we,” “us,” or “our”). This comprehensive document outlines the Terms and Conditions of Service (“Terms”) that govern your relationship with CY&A, including all aspects of enrollment, financial transactions, participation in our programs, use of our facility located at 2701 MITCHELL ROAD SUITE A, CERES, CA 95307, and engagement with our website and communications (including our email address info@calyouth.site). By accessing our website, registering a student (referred to as the “Student”), volunteering, donating, or participating in any program, event, or activity provided by CY&A, you (referred to as the “Parent,” “Guardian,” “Participant,” or “User”) hereby acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms and Conditions in their entirety. These Terms constitute a legally binding agreement between you and CY&A. If you do not agree with any part of these Terms, you must immediately cease all use of our services and refrain from enrolling in our programs. Enrollment and continued participation are strictly conditioned upon your acceptance of, and adherence to, all provisions within this document, as they may be updated periodically.
1.2. Effective Date and Modifications
These Terms and Conditions are effective as of November 12, 2025. CY&A reserves the unilateral right, at any time and for any reason, to modify, amend, or update these Terms without prior written notice, beyond posting the revised document on our official website. Any changes or modifications will become effective immediately upon being posted to the website, and your continued engagement with CY&A programs or services following the posting of the revised Terms constitutes your irrevocable acceptance of those changes. It is your continuous responsibility to review these Terms periodically for any updates or amendments, ensuring you remain fully compliant with the current governing agreement. We recommend printing a copy of these Terms for your records at the time of initial enrollment and upon any subsequent material updates.
1.3. Definitions of Parties and Services
For clarity within this agreement, the following terms shall have the meanings ascribed to them:
- “CY&A” refers to CALIFORNIA YOUTH & ARTS, the non-profit organization providing arts education.
- “Student” refers to the minor child registered for and participating in any CY&A program.
- “Parent” or “Guardian” refers to the adult legal representative responsible for the Student, who is entering into this agreement with CY&A. This person is financially responsible for all tuition and fees.
- “Participant” refers to any individual, including Students, Parents, Guardians, volunteers, or visitors, engaging with CY&A services or facilities.
- “Programs” refers collectively to all classes, workshops, camps, mentorships, performances, exhibitions, and related educational activities offered by CY&A.
- “Facility” refers to the physical premises located at 2701 MITCHELL ROAD SUITE A, CERES, CA 95307, where programs are held.
2. Enrollment, Registration, and Program Participation
2.1. Eligibility and Enrollment Process
Enrollment in CY&A Programs is open to youth within the age parameters specified for each class, camp, or workshop. The Parent or Guardian must complete the official online or physical registration form in full, providing accurate, truthful, and complete information, including all current contact details and mandatory medical and emergency data. Enrollment is not finalized until the Parent or Guardian has received a written Confirmation of Enrollment from CY&A, and the initial required payment (deposit or full tuition, as specified) has been successfully processed and cleared. Submission of the registration form is considered an unconditional commitment to pay all associated tuition and fees unless the enrollment is officially cancelled in accordance with Section 3.4 (Refund Policy). CY&A reserves the absolute right to deny or revoke enrollment to any Student or Participant at its sole discretion, at any time, for any reason, including but not limited to, failure to meet prerequisites, failure to adhere to the code of conduct, or non-compliance with these Terms.
2.2. Attendance, Punctuality, and Pick-Up Policy
Parents and Guardians are responsible for ensuring the Student attends all scheduled Program sessions punctually. Consistent tardiness or absences may disrupt the learning environment for other Students and mentors, and no refunds or pro-rated adjustments will be provided for missed sessions, regardless of the reason for the absence. For the safety of the Student, Parents or Guardians must strictly adhere to the designated drop-off and pick-up times for all Programs held at the 2701 MITCHELL ROAD SUITE A facility. Any Student picked up late may be subject to a late pick-up fee, which is automatically assessed per a published schedule, and must be paid immediately. Repeated late pick-ups may, at CY&A’s sole discretion, result in the immediate and permanent suspension of the Student from the Program without refund, as it constitutes a violation of the behavioral policy and strains staff resources.
2.3. Program Changes and Cancellations
CY&A reserves the right to cancel, postpone, reschedule, or modify any Program, class, or workshop due to insufficient enrollment, mentor illness or unavailability, facility emergencies, or events of force majeure (such as natural disasters or government mandates). In the event CY&A cancels a Program entirely before it begins, Parents will be offered a full credit toward another CY&A Program or a full refund of tuition and fees paid. If a Program is cancelled after it has commenced, a pro-rated refund or credit will be issued based on the remaining number of scheduled sessions. CY&A will make all reasonable efforts to notify affected Parents or Guardians of any schedule changes via the email address (info@calyouth.site) and phone number provided during registration, and it is the Parent’s responsibility to monitor these communication channels. CY&A is not responsible for any ancillary costs incurred by the Parent or Student (such as travel, accommodation, or external supplies) due to Program cancellations or changes.
3. Financial Terms and Payment Policies
3.1. Tuition, Fees, and Payment Obligation
The Parent or Guardian enrolling the Student is unconditionally responsible for the timely payment of all stated tuition fees, material fees, administrative fees, and any other charges levied by CY&A related to the Student’s participation. Tuition amounts are published on the website or provided in the official registration documentation and are subject to change for future enrollment periods. Payment schedules (e.g., deposit, installment plans, full upfront payment) must be adhered to precisely. Failure to submit payment by the specified due date may result in a late payment fee being assessed, and continued delinquency will result in the immediate and automatic suspension of the Student from all Programs until the balance is paid in full, with no refund or credit granted for missed sessions during the suspension period.
3.2. Material and Administrative Fees
In addition to tuition, certain Programs may require the payment of non-refundable material fees to cover specialized supplies (e.g., ceramics clay, glazes, digital software licenses, unique art papers) and essential administrative costs (e.g., registration processing, insurance overhead). These fees are due at the time of initial registration and are non-refundable regardless of whether the Student attends the Program, as they cover resources secured or administrative work completed immediately upon enrollment confirmation.
3.3. Financial Aid and Scholarship Acceptance
CY&A, as a non-profit organization, strives to make its Programs accessible through need-based scholarships and financial aid. Any application for and acceptance of financial aid, a scholarship, or a reduced tuition rate constitutes an explicit agreement to the specific terms and conditions governing that award, which may include attendance requirements, volunteer commitments from the Parent, or performance benchmarks for the Student. If the Student fails to meet the specific requirements of the financial aid award (e.g., unexcused absences exceed a set threshold), CY&A reserves the right to immediately revoke the award, requiring the Parent to pay the full remaining balance of the standard tuition rate for the remainder of the Program within ten (10) calendar days of written notification.
3.4. Refund and Cancellation Policy
All requests for cancellation and refunds must be submitted in writing via email to info@calyouth.site. Refunds are processed based on the following strict schedule, acknowledging the resource commitments CY&A makes to staff and materials based on confirmed enrollment numbers:
- Cancellation 30 Calendar Days or More Before Program Start: A full refund of tuition paid will be issued, minus a non-refundable $50.00 administrative processing fee and any material fees already incurred or paid.
- Cancellation Between 14 and 29 Calendar Days Before Program Start: A refund of 50% of the total tuition paid will be issued. The administrative fee and material fees remain non-refundable.
- Cancellation Less Than 14 Calendar Days Before Program Start: No Refund of tuition will be issued, as enrollment counts have been finalized, and staff/materials commitments have been secured.
- Cancellation On or After Program Start Date: No Refund, Credit, or Prorated Adjustment will be issued for any reason, including illness, family emergencies, change of plans, or withdrawal from the Program. Tuition is assessed based on enrollment, not attendance, and withdrawal after the start date deprives another Student of a slot.
4. Student and Parent Code of Conduct
4.1. Behavioral Expectations for Students
All Students are expected to adhere to a strict Code of Conduct that promotes a safe, respectful, and focused learning environment conducive to artistic exploration. Students must demonstrate respect toward all Mentors, staff, volunteers, fellow Students, and property, including the facilities at 2701 MITCHELL ROAD SUITE A. Disruptive behavior, including but not limited to: chronic non-compliance with mentor instructions; verbal abuse, profanity, or bullying of any form (physical or digital); harassment; willful damage to property or artwork; or any behavior that compromises the safety or educational experience of others, is strictly prohibited. CY&A maintains a zero-tolerance policy for harassment, bullying, and violence.
4.2. Disciplinary Action and Suspension
Mentors and staff are authorized to implement a progressive disciplinary process, beginning with verbal warnings and time-outs. However, CY&A reserves the absolute and immediate right to suspend or permanently expel a Student from any Program without prior warning or recourse, and without a refund of any tuition paid, for severe breaches of the Code of Conduct, including but not limited to: violence, harassment, use of illegal substances, or repeated, uncorrected minor misconduct. The determination of a disciplinary violation and the resulting action rests solely with the CY&A Executive Director, whose decision is final and non-appealable. Parents agree to accept and abide by any disciplinary action taken by CY&A.
4.3. Parent/Guardian Conduct
Parents and Guardians must conduct themselves professionally, respectfully, and courteously during all interactions with CY&A staff, mentors, volunteers, and other families, whether at the Facility, via email (info@calyouth.site), or by phone. Disrespectful, aggressive, or harassing communication toward any CY&A personnel or other families will be treated as a severe violation of these Terms and may result in the immediate and permanent termination of the Student’s enrollment without refund. Parents are prohibited from attempting to negotiate staffing, curriculum, or disciplinary decisions directly with Mentors; all such matters must be addressed through the official administrative channel via info@calyouth.site or the Program Director.
5. Intellectual Property and Media Release
5.1. Ownership of Student Work
CY&A acknowledges that the Student is the original creator and owner of the intellectual property rights, including copyright, in any artwork, performance, composition, design, or written work created by the Student during their participation in a CY&A Program (“Student Work”). CY&A makes no claim of ownership over the underlying Student Work itself. The Student (and Parent/Guardian, on the Student’s behalf) may remove the Student Work from the Facility upon the completion of the Program, subject to any material fees having been paid and any exhibition agreements having been concluded.
5.2. Grant of License to CY&A
By enrolling a Student in a Program, the Parent/Guardian hereby grants to CY&A, its affiliates, successors, and assigns, an irrevocable, perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, display, exhibit, distribute, and create derivative works from the Student Work solely for the purpose of promoting CY&A’s educational mission, Programs, fundraising efforts, and for archival purposes. This license permits CY&A to display the Student Work in our Facility (2701 MITCHELL ROAD SUITE A), on our official website (calyouth.site), in digital or printed promotional materials, and on social media, without any further compensation to the Student or Parent. This license does not grant CY&A the right to sell the Student Work for commercial profit, beyond its use for organizational fundraising.
5.3. Media and Likeness Release
The Parent/Guardian irrevocably grants CY&A and its assigns the unrestricted, perpetual, non-exclusive, royalty-free right and license to photograph, videotape, audio record, or otherwise capture the Student’s likeness, image, voice, performance, and/or biographical information (“Likeness”) while participating in CY&A Programs or activities, both at the Facility and during off-site, sanctioned events. This Likeness may be used, without further compensation, across all media now known or hereafter devised, solely for the purpose of promoting, marketing, and documenting CY&A and its mission. Use includes, but is not limited to: inclusion in promotional videos, website galleries, social media posts, annual reports, fundraising appeals, and press releases. Should a Parent/Guardian wish to opt-out of this Media and Likeness Release, they must submit a formal, written request to info@calyouth.site at the time of enrollment. CY&A will make reasonable efforts to honor written opt-out requests, but cannot guarantee that the Student’s Likeness will not appear in group photos, background video footage, or materials printed prior to the receipt of the opt-out request.
6. Safety, Liability, and Medical Provisions
6.1. Assumption of Risk and Waiver of Liability
The Parent/Guardian acknowledges that participation in artistic, creative, and physical activities—including but not limited to ceramics, painting, sculpture, dance, and theatrical performance—involves inherent risks, dangers, and hazards that may result in injury, sickness, or death. These risks include potential exposure to certain art materials (including dust, chemical fumes, sharp tools, and hot surfaces), risks associated with facility use, and risks inherent to group activities. By executing these Terms, the Parent/Guardian, on behalf of themselves and the Student, knowingly and voluntarily assumes all such risks. Furthermore, the Parent/Guardian hereby agrees to waive, release, discharge, and hold harmless CY&A, its officers, directors, employees, mentors, volunteers, and agents from any and all liability, claims, demands, costs, losses, or expenses arising out of or related to any loss, injury, death, or property damage that may be sustained by the Student or Parent/Guardian while participating in CY&A Programs or utilizing the Facility, whether arising from the negligence of CY&A or otherwise, to the maximum extent permitted by California law.
6.2. Medical Consent and Emergency Procedures
The Parent/Guardian warrants that the Student is physically fit and capable of safely participating in the selected Program(s). The Parent/Guardian is required to disclose all necessary medical information, allergies, and special needs at the time of enrollment. In the event the Parent/Guardian or the Student’s designated emergency contact cannot be immediately reached, the Parent/Guardian grants CY&A personnel full authority to authorize any and all necessary emergency medical treatment, hospitalization, or surgical care for the Student, including necessary transportation to a medical facility. The Parent/Guardian is solely responsible for all costs associated with such emergency medical care, and CY&A is granted immunity from liability for all decisions made in good faith during an emergency situation.
6.3. Acknowledgment of Inherent Risks in Art Materials
The Parent/Guardian acknowledges being informed and accepting the inherent risk associated with working with professional art materials. While CY&A strives to use non-toxic or low-toxicity materials, especially in youth programs, some materials may pose risks if misused. The Parent/Guardian agrees to instruct the Student to follow all mentor instructions regarding the safe handling of tools, chemicals, and equipment at the Facility (2701 MITCHELL ROAD SUITE A), and will hold CY&A harmless for any injury or adverse reaction resulting from the Student’s failure to adhere to these stated safety instructions.
7. Termination, Suspension, and Remedies
7.1. CY&A’s Right to Terminate Enrollment
CY&A reserves the right, at its sole and absolute discretion, to immediately suspend or permanently terminate a Student’s enrollment and access to all services, without prior notice and without refund of any tuition or fees paid, upon the occurrence of any of the following events: (a) Student or Parent/Guardian fails to adhere to the Code of Conduct (Section 4); (b) failure to make any required financial payment in a timely manner (Section 3); (c) provision of false, misleading, or incomplete information on registration forms; (d) any action that poses a safety or security threat to other Participants or the Facility; or (e) breach of any other term or condition within this Agreement. Upon termination, the Student must be immediately withdrawn from the Facility.
7.2. Remedies for Breach
In addition to the right to terminate enrollment, CY&A reserves all legal and equitable remedies available for any breach of these Terms by the Parent, Guardian, or Student, including but not limited to the right to recover all costs and fees incurred by CY&A resulting from the breach (e.g., costs associated with repairing damage to the Facility, legal fees, and collection agency fees).
8. Warranties, Disclaimers, and Limitation of Liability
8.1. Disclaimer of Warranties
CY&A provides its Programs and services, including the use of the Facility, on an “as is” and “as available” basis. CY&A makes no warranties, express or implied, regarding the specific artistic outcome or educational result of any Program. We specifically disclaim all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. CY&A does not warrant that the website or communication channels (info@calyouth.site) will be uninterrupted, error-free, or secure.
8.2. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall CY&A, its officers, directors, mentors, employees, or agents be liable to the Parent, Guardian, Student, or any third party for any direct, indirect, punitive, incidental, special, or consequential damages, or any damages whatsoever, including without limitation damages for loss of use, data, or profits, arising out of or in any way connected with: (a) the use or performance of our services or website; (b) the delay or inability to use our services; (c) the provision of or failure to provide services; or (d) any termination of enrollment or disciplinary action. The total cumulative liability of CY&A arising out of or related to this agreement, whether in contract, tort, or otherwise, shall not exceed the total amount of tuition and fees actually paid by the Parent/Guardian to CY&A for the specific Program that gave rise to the claim.
9. General Legal Provisions
9.1. Governing Law and Venue
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the services provided by CY&A shall be exclusively instituted in the state or federal courts located in Stanislaus County, California (where our facility at 2701 MITCHELL ROAD SUITE A is located), and you hereby consent to the exclusive jurisdiction and venue of such courts.
9.2. Dispute Resolution
In the event of any dispute or claim arising under these Terms, the parties agree to first attempt to resolve the matter amicably through good faith negotiation and internal administrative review. If the dispute cannot be resolved within thirty (30) days of initial notification, the parties agree to submit the dispute to binding arbitration in Stanislaus County, California, administered by a mutually agreed-upon arbitrator in accordance with the rules of the American Arbitration Association (AAA). The decision of the arbitrator shall be final and binding, and judgment may be entered upon it in any court having jurisdiction.
9.3. Severability and Entire Agreement
If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. This document, together with the completed Enrollment Form and any specific Program documents, constitutes the entire agreement between you and CY&A concerning the subject matter herein and supersedes all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written.
